Notice Periods in Plain Language

Notice Periods in Plain Language

Notice is how a lease ends on a date both sides can plan around. It is not a vibe, a booking end date, or a message that says “I’m going home.” ManjeProp will look at the written agreement first. South African statutes sit on top of that paper. This note is a map, not a legal opinion, and not a calculation of your exact last day.

If a lot of rent sits on the date, get advice. We will not pretend a blog post is that advice.

Read the clause you already signed

Find: how much notice, how it must be sent, when it starts running, and whether the lease is fixed-term or month-to-month. Some student agreements end on a fixed date unless someone renews. Some roll on. Those are different machines.

Send notice the way the clause says — the email address, the form, the physical address. Keep a copy. A WhatsApp that was not answered is a weak file.

A PropertyCare booking row is not notice. An enquiry about a different room is not notice.

Fixed-term and month-to-month are not the same

A fixed-term lease usually runs to its end date. Leaving early can have consequences the lease and, where it applies, the Consumer Protection Act describe for consumer agreements — including notice measured in business days and possible reasonable charges. The detail depends on who you are and what you signed. Do not copy a forum post from 2014.

A month-to-month arrangement, if that is what you legally have, usually needs notice measured in the lease or in ordinary rental practice. “Two weeks because exams ended” is not a rule unless the paper says so.

We will not invent a number of days for you here. We will tell you to put the paper on the table.

Dates that are not notice

  • The day your last exam ends
  • The day the fridge broke
  • The day a housemate left
  • The day a listing appeared for “your” room
  • The day you stopped paying because you were angry

A genuine uninhabitable failure is a different conversation — safety, tickets, and possibly legal advice. It is not a silent walk-away. Send the faults on Report a fault so the condition is dated.

Landlords and staff

Do not advertise a room as vacant because you think someone will give notice. Do not confirm a replacement booking over an overlap warning while the current lease still has time to run and the person has not vacated.

If you must write a letter about notice, have it reviewed if it threatens legal consequences. The letters module is not a lawyer.

Record the date the notice arrived, the method, and the date you calculate as the end. Do not store an identity document in that note.

Inspections follow the end, they do not replace it

The Rental Housing Act’s outgoing inspection window sits near expiry. It does not write your notice for you. Book the walk when the end date is known. Photograph. Return keys on that sequence.

Deposit timing in the Act is tied to expiry and restoration, not to the day someone sent a voice note.

Parents

If you pay the rent, you still need the student to send the notice the lease describes, unless you are a party to the agreement and the clause allows you to act. Ask early in the term, not the week before a flight.

Questions about taking a different Durban room belong on the enquiry form. Do not use the fault form to resign a lease.

What we will not calculate in a caption

We will not tell you that “20 business days always applies” or that “one calendar month always applies.” Those phrases come from different statutes and different kinds of agreement. The wrong number, published as if it were yours, is how someone misses a flight or a refund window.

If staff give you a date, they should be able to point at the clause they used. If they cannot, ask them to look again. If you still disagree, that is advice territory, not a plumbing ticket.

A plain working habit

Decide. Read the clause. Send the notice in the required form. Keep the proof. Book the inspection. Photograph the meter. Return the keys. Then argue, if you must, with a file.

Do not stop reporting faults because you have given notice. A leak in the last fortnight is still a leak. It is also how a deposit file stays honest.

For the current wording of the Rental Housing Act or the Consumer Protection Act, use the official text or an adviser. For a leak while you are still in occupation, use the fault form or +27 60 313 6961.
